Apple Wars

On one side, we have New York City (a.k.a. The Big Apple) and their new GreeNYC campaign with its new green apple logo.On the other, it's Steve Jobs and company, who say the logo's resemblance to the Apple logo infringes on the company's trademark.
Here are both sides of the argument (according to Wired.com):
- Apple -- The GreeNYC logo will confuse consumers and "seriously injure the reputation which [Apple] has established for its goods and services."
- NYC -- Nobody is likely to be confused and their new logo is none of Apple's beeswax.

Using the Apple nickname and having a logo is not the same – does NYC have an apple logo – if so and is this green apple a spinoff – then they have a stronger leg to stand on. Having never seen a NYC apple logo before, this one is just a tad too close – remember trademark and trade dress laws are about confusion to the average person AND just as importantly, if Apple lets others willy-nilly use a similiar looking apple logo go also – others will just edge closer claiming that Apple has by NOT suing in effect abandoned its trademark … so in a happy go lucky world that is not America, yea, it’s different but in AMERICA, it’s close enough they have to put up their lawyerly dukes and see where it goes.
Tell NYC to get another logo that is not used by a successful computer and consumer products company — Apple…
It’s ridiculous that NYC is trying to leverage attention to their campaign off the back of a popular logo that has been built up by Apple over 30 years.
